The incident took place on June 12 when a woman in her 60s was queuing to buy frozen yogurt in front of another woman and her son in a stroller, the San José Police Department said.
“The preliminary investigation revealed that the lady was upset that the woman did not maintain an adequate social distance, so she decided to take off the mask, approach the baby’s face and cough two or three times”said the police sergeant.

After the video of the incident went viral, the Oak Grove School District in San Jose confirmed that the woman who coughed with the baby could be one of its employees.
“We are aware of an incident that allegedly involved one of our employees who was videotaped coughing up a baby in a local Yogurtland«, The district said in a statement.
“We have been in contact with the San José Police Department, which is investigating this incident and working to confirm the identity of the person involved.”
The district said police ordered them to refrain from taking action on this matter while the investigation is pending.
«The employee is currently out of work and does not provide any services to the students of our district», the statement read.
